Welcome to Cat Café Studio! These Terms and Conditions (“Terms”) govern your access and use of both the Cat Café Studio Website (“Site”) and the physical premises of Cat Café Studio (“Café”). By accessing or using our Site, or by visiting the Café, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must refrain from using the Site or visiting the Café.

Section I: Site Terms and Conditions

1. Introduction and Scope

1.1. Ownership of the Site: The Site (www.catcafestudio.com) is owned and operated by Cat Café Studio (“we,” “us,” or “our”). All intellectual property, content, and services provided on the Site are proprietary to Cat Café Studio and its licensors.
1.2. Agreement to Terms: These Terms serve as a legally binding agreement between you and Cat Café Studio. By accessing the Site, you acknowledge that you have read, understood, and agreed to these Terms.
1.3. User Eligibility: By using the Site, you represent that you are at least 18 years old or have the legal consent of a parent or guardian to use the Site. If you are accessing the Site on behalf of a company or legal entity, you represent that you have the authority to bind such entity to these Terms.
1.4. Governing Law: The use of the Site, and these Terms, shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to the Site or these Terms will be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

3. Purchases, Pricing, and Payment Terms

3.2. Order Confirmation: Upon successful payment, you will receive an email confirming your order or booking. If you do not receive this email, please check your spam/junk folder or contact us.
3.3. Pricing and Availability: Prices for products and services are displayed on the Site and are subject to change without notice. While we strive to provide accurate pricing information, we reserve the right to correct any pricing errors.
3.4. Refunds and Cancellations: Any cancellations, refunds, or exchanges are subject to specific policies depending on the type of product or service purchased. 3.5. Refund Process: All refunds will be processed through NEFT (National Electronic Funds Transfer) and will be cleared within 7-15 business days from the date of the cancellation approval. Customers will be required to share their bank account details and provide proof of payment (e.g., a screenshot or receipt of the original transaction) in order to initiate the refund process.

4. Intellectual Property
4.1. Ownership of Content: All content on the Site, including text, images, graphics, logos, and videos, is the intellectual property of Cat Café Studio or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission.
4.2. Trademarks: The Cat Café Studio name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cat Café Studio. You may not use these trademarks without prior written consent.
4.3. User-Generated Content: If you submit or post any content to the Site (e.g., reviews, comments), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute such content in connection with the operation of the Site.

5.Disclaimers and Limitation of Liability
5.1. Disclaimer of Warranties: The Site and its content are provided on an “as-is” and “as-available” basis, without any warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2. Limitation of Liability: To the fullest extent permitted by law, Cat Café Studio will not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to your use of the Site, including any loss of data, revenue, or profit.

Section II: Café Terms and Conditions

6. Customer Obligations and Behaviour

6.1. Respectful Conduct: All customers visiting Cat Café Studio are expected to behave in a respectful and considerate manner toward the staff, other guests, and the cats. Disruptive or harmful behaviour, whether verbal or physical, will not be tolerated and may result in immediate removal from the premises.
6.2. Animal Care and Interaction:
6.2.1. Appropriate Behaviour: Cat Café Studio serves as a foster home for many senior and special needs cats, and we prioritize their safety and well-being. Visitors must treat the cats gently and responsibly, avoiding loud noises, aggressive actions, or chasing them.
6.2.2. Supervision of Children: Children under the age of 16 must be closely supervised by a parent or guardian at all times to ensure the safety of both the child and the cats.
6.2.3. Right to Admission: If a visitor engages in prohibited behaviour, they will be issued three warnings before being asked to leave the premises. If the behaviour persists, Cat Café Studio reserves the right to ask the visitor to leave to maintain a safe and pleasant environment for everyone.
6.2.4. Pet Policy: Outside pets are not allowed in the Café due to the safety and well-being of our resident cats.

7. Café Experience Guidelines
7.1. Photography: Visitors are encouraged to take photographs of the Café and the cats. However, flash photography is strictly prohibited to protect the cats from harm. Use of professional photography or videography equipment requires prior permission, which can be requested via email at info@catcafestudio.com.
7.2. Food and Drink Policy: Bringing outside food or beverages into the Café is not allowed, with the exception of dietary restrictions for children under the age of two. We offer a variety of food and beverages for purchase that cater to the preferences of our guests.
7.3. Animal Intake Policy: Cat Café Studio is a private organization that independently rescues animals. We are not compelled by government regulations or external entities to alter our animal intake policy, which is solely within our discretion. We retain the authority to determine which animals we will accept. Please be advised that abandoning animals at Cat Café Studio’s property will result in legal action against the individual responsible.

8. Café Safety and Liability
8.1. Allergic Reactions: While we strive to maintain a clean and safe environment, customers who are allergic to cats or other allergens are responsible for managing their own exposure risks. Cat Café Studio will not be held liable for any allergic reactions.
8.2. Accidents and Injuries: Visitors must take care to avoid accidents involving the cats or any Café facilities. Our cats are domesticated and human-friendly; however, some may not tolerate teasing, tickling, or touching their tails, bellies, or private parts, and visitors are advised to exercise restraint and caution while playing with the cats. While we take reasonable precautions to maintain a safe environment, Cat Café Studio is not responsible for any injuries, whether caused by interactions with cats or other factors.
8.3. Prohibited Actions: Aggressive or harmful behaviour toward the cats, including but not limited to hitting, kicking, or scaring them, will result in immediate expulsion from the Café.

9. Café Disclaimer and Limitation of Liability 9.1. No Guarantees: While we strive to provide an enjoyable experience, we do not guarantee the availability of specific cats at the Café or the continuous availability of any specific services. Cats are free to roam and may not always be present or interact with visitors.
9.2. No Responsibility for Personal Property: Cat Café Studio is not responsible for any lost, stolen, or damaged personal belongings during your visit. Visitors are responsible for the security of their own items.
9.3. Right to Refuse Service: Cat Café Studio reserves the right to refuse entry or service to anyone who does not comply with the Café’s policies.

Section III: Common Terms and Conditions

10. Refunds, Payments, and Bookings
10.1. Products from the Shop Page
10.1.1. Unboxing Video Requirement: Customers are required to make an unboxing video when receiving their product to document any potential damage.
10.1.2. Damaged Product Claims: If it is proven, via the unboxing video, that the customer received a damaged product, a replacement or refund will be issued. No refund or replacement will be issued for damages caused by the customer after delivery.
10.1.3. Process for Replacement or Refund: Once a damage claim has been reviewed and approved, a replacement or refund will be initiated within the aforementioned NEFT refund timeline of 7-15 business days.
10.2. Ticketed Events
10.2.1. Non-Refundable Ticket Policy: Tickets for events hosted by Cat Café Studio are non-refundable.
10.2.2. Event Cancellation by Organizer: In the case where Cat Café Studio or the event organizer cancels an event, a full refund will be initiated automatically within the NEFT refund timeline of 7-15 business days.
10.3. Pop-Up Stalls
10.3.1. Booking Refund Policy: A full refund will be issued if the booking is cancelled within 48 hours of the original booking date. After 48 hours, only 50% of the rental amount will be refunded if the booking is cancelled.
10.3.2. Responsibility of Sales: Cat Café Studio provides only the rental space for pop-up stalls and is not responsible for the sales or customer service issues related to the brand renting the space. Any disputes regarding sales must be handled directly with the brand.
10.4. Art Studio Rental:
10.4.1. Full Refund Policy: A full refund will be issued if the booking is cancelled within 48 hours from the date of the original booking. Post which 50% of the rental will be deducted if a cancellation of the booking takes place.
10.4.2. Partial Refund After 48 Hours: If a cancellation is made after 48 hours from the booking date, 50% of the rental amount will be deducted from the refund.
10.4.3. Rescheduling Policy: The event can be rescheduled up to two times at no additional cost, subject to date availability. After two rescheduling requests, no further rescheduling will be accepted, and the booking will be considered cancelled without any refund or rescheduling options.

11. Discrimination Policy: At Cat Café Studio, we are committed to fostering an inclusive and welcoming environment for all.
Zero Tolerance: We strictly adhere to a zero-tolerance policy prohibiting any form of discrimination, harassment, or bullying based on race, ethnicity, gender, sexual orientation, age, disability, religion, or any other protected characteristic under applicable laws. Individuals found in violation of this policy will be subject to disciplinary action, which may result in removal from the premises and a permanent ban from future visits.

12. Acknowledgment and Acceptance:
By using our Site or visiting the Café, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in their entirety. These Terms form a binding agreement between you and Cat Café Studio, and your use of the Site or visit to the Café constitutes acceptance of these Terms.
